(CN) – An Albuquerque food truck owner is suing her neighbor for targeting her with an aggressive campaign of petitioning to ban her from her home for parking and violating parking laws. Albuquerque's 99 Food Truck, owned by Lilia Alvarez, is being sued by Don Barton, an attorney who lives across the street. According to the lawsuit, Barton filed a petition with the city in August 2015, which led to a Neighborhood Code Enforcement Committee hearing in October. At the hearing, Barton argued that Alvarez parked her food truck in her driveway and that she was "storing and distributing food." He told the committee that the trucks "parked in the driveway, at all hours of the day and night, and that the 'driveway was basically unusable,'" the lawsuit states. Barton told the committee that Alvarez was parking food-carrying trucks on top of his truck. He also stated that the trucks took up a full driveway in order to park there, but the trucks took up about 80 percent of the drive, according to the complaint. Alvarez testified that she was running a food truck to generate income to pay off her mortgage, and her food truck parked in her driveway for only a few hours in the morning and in the evening. She also testified that she parked the trucks at the time of day when she closed her business. The Neighborhood Code Enforcement Committee found that Alvarez "committed numerous parking and zoning violations," according to the complaint. In October, the city passed a resolution that stated the trucks were "illegal," with the option to purchase a commercial permit for Alvarez for $1,550 per month. Alvarez's
